The loss of a loved one is an inherently difficult time. Amidst the emotional challenges of bereavement, the legal and administrative tasks required to settle an estate can feel overwhelming. Navigating the Executry Process

The term Executry refers to the entire legal process of winding up a deceased person’s estate. This involves identifying all assets, paying off any outstanding debts or taxes, and finally distributing the remaining estate to the beneficiaries. Whether the deceased left a Will or died intestate, our solicitors ensure that every legal obligation is met with precision.

One of the primary stages in this process is obtaining Probate in Scotland, which is legally referred to as ‘Confirmation’. This is the court document that grants the executor the formal authority to uplift assets from banks and transfer property. We handle the technical paperwork involved in the application to the Sheriff Court, ensuring that the inventory of the estate is accurate and that all valuations are professionally handled.

Understanding Rights and Responsibilities

For many, the first question after a loss is simply: What happens when someone dies in Scotland? The Scottish legal system has unique rules, particularly regarding “Prior Rights” and “Legal Rights,” which ensure that certain family members have a claim on the estate regardless of what is written in a Will.

Our team provides expert clarity on these rules, especially when it comes to Claims on Inheritance. Disputes can arise during the administration of an estate, whether through a challenge to the validity of a Will or a disagreement over the distribution of assets. My first connection with Gibson Kerr was in 2009 when my dad died. My mum was then 88 and thankfully we had Scott to steer us through all of the intricacies involved with Power of Attorneys etc. As I live in Australia his assistance was invaluable and nothing was too much trouble. (My sister lived in France just to confuse things even further). In 2018 my sister died and again we contacted Gibson Kerr. Lindsay then took over and assisted my mum and reassured her everything was still in order. In 2019 my mum finally arranged to enter Residential Care and between us Scott and I sold my mum’s house and he took care of the legalities. I would have been lost without him. Unfortunately my mum died in September 2020. The pandemic meant I was stuck in Australia – it was almost impossible to get out of the country never mind back in – so I again took advantage of Lindsay who handled everything for me. Probate was finally granted and the estate wound up in August 2021. Without Scott and Lindsay I would have been in an invidious situation on a few occasions. Luckily we had all the necessary documentation to hand but I was 12,000 miles away and in some instances had fun getting my signature witnessed etc, and hoping that the mail (during Covid 2020) would deliver. It could be stressful but without Scott and Lindsay over the years to help me out I would have never, ever coped.
